Payment Terms
Each Customer is responsible for any and all fixed and accumulative charges for their account. The first month service fee (or other available billing period selected) is due upon account setup. Each month (or other billing period selected), on the date of the application, the account will be charged the monthly access and any other fees for the new month plus any accumulated charges for the past month. Unused hours do not accrue from one month to the next. Failure to use this account(s) does not relieve the user of payment obligations.
Further, you are responsible for ALL charges associated with connecting to HI Surfer.Net. You agree that any telephone charges incurred are your responsibility. Depending upon your calling location, the nearest access number may not be a local phone call and you may be subject to long distance charges. You should check with your local phone company to determine whether any particular access number is a local call. If you access HI Surfer.Net. from certain access numbers, you may be assessed communication surcharges on your telephone bill. You are responsible for all activities and charges under your account(s), including any unauthorized charges to your account.

CREDIT CARD:

Credit Card customers agree to allow HI Surfer.Net. to bill such card on each successive billing date without obtaining the user's permission after the initial charge. Credit Card customers shall notify HI Surfer.Net. of any changes in Credit Card Number or expiration date. If the card is not honored for any reason, HI Surfer.Net. will attempt to notify the card holder by using the telephone information given at sign-up and by E-mail. HI Surfer.Net. will call the card holder, and if alternative billing has not been established within five (5) days, the account will be disabled.

CHECK:

If payment is by check or money order, payment due dates are indicated on your Email invoice. Dishonored checks are subject to a collection fee and your account may be suspended until the account is current. If payment is not received within five (5) days of the due date, service will be terminated until such time that payment has been received by HI Surfer.Net.

Echeck.Net

Echeck.Net customers agree to allow HI Surfer.Net. to bill such checking account on each successive billing date without obtaining the user's permission after the initial charge. Echeck.Net customers shall notify HI Surfer.Net. of any changes in billing bank account. If the bank account is not honored for any reason, HI Surfer.Net. will attempt to notify the customer by using the telephone information given at sign-up and by E-mail. HI Surfer.Net. will call the customer, and if alternative billing has not been established within five (5) days, the account will be disabled.

  Your account must be paid by the 15th of each month, following receipt of your invoice to remain an active account.  HI Surfer.Net reserves the right to deactivate any account, that has not paid its current or past due monies within the allotted time above, without notice.    HI Surfer.Net also reserves the right to change its billing policy without notice.   Any change in its billing policy will be posted in the HI Surfer.Net online web newsletter and on HI Surfer.Net's Payment Policy web page.

Client Rights
The right to use HI Surfer.Net.'s service is not transferable. Accounts are for your use only! User is responsible for the confidentiality of user's passwords. Loaning your account to others, connecting a system used by multiple persons, group use of user log-ins, and consuming more than one modem line are explicitly prohibited unless agreed upon in advance by HI Surfer.Net. If the user has multiple accounts, then the user is limited to one log-in session per system account at any time. Violation of this policy will be considered as theft of service and will be prosecuted under civil and criminal law.

HI Surfer.Net.'s services should not be used to send unsolicited advertising or promotional materials to other network users. Electronic mail and appropriate Usenet newsgroups may be used in the conduct of legitimate business. We do not allow users to run Mail lists, Listservers or any form of auto-responder from a users account. Processes that run or are activated while the user is not logged in are also NOT ALLOWED. Continued harassment of other individuals on the Internet after being asked to stop by those individuals and HI Surfer.Net. will not be tolerated. When HI Surfer.Net. becomes aware of possible violations, HI Surfer.Net. will initiate an investigation. At the same time, in order to prevent further possible unauthorized activity, HI Surfer.Net. may suspend access to services to the individual account in question. Confirmation of violations may result in cancellation of the individual account and/or criminal prosecution. The account suspension may be rescinded at the discretion of HI Surfer.Net. following payment of a reconnection charge. Use of this account to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that deemed threatening or obscene, or engaging in any kind of illegal activity is expressly prohibited. Client will abide by all the rules, regulations and policies of those networks and computer systems accessed via this account. If the Client is unsure of those policies, it is the Client's responsibility to ascertain said policies.

These terms and conditions are subject to change without notice. A current copy will be available on-line on HI Surfer.Net's home page. Continued usage of your account after a new policy has gone into effect constitutes acceptance of that policy. We encourage you to regularly check the policy statement for any changes.

Cancellation and Termination of Contract

HI Surfer.Net. has the right to terminate service for any unpaid subscriptions. Accounts in default are subject to an interest charge of 1.0% per month (12% per annum) on the outstanding balance. Termination of service shall not relieve the user from the obligation to satisfy outstanding invoices. In the event HI Surfer.Net. utilizes an attorney to collect such sums, the user shall be responsible for the payment of all of HI Surfer.Net.'s attorneys' fees and costs, allowable by Pennsylvania State law, in the collection of these sums. Any litigation concerning the user's relationship with HI Surfer.Net. shall be in Westmoreland county, in the state of Pennsylvania.

HI Surfer.Net. reserves the right to cancel service for any reason without prior notice. In case of cancellation, unused fees may be returned to the user on a monthly basis.

Termination or Suspension does not release liabililty for charges due. HI Surfer.Net. may delete all data, files or other information that is stored in subscriber's account of hosted Web Site upon termination.

The client must notify HI Surfer.Net. to cancel service. THE ONLY METHOD OF CANCELLATION ACCEPTED BY HI SURFER.NET FROM A CUSTOMER IS VIA TELEPHONE AT OUR TOLL FREE NUMBER 866.748.3463. Fees for any setup, software, and the first month's service are not refundable, unless the customer is unsuccessful in using the account and notifies HI Surfer.Net. within five (5) days of establishing said service. There are no refunds for semi-yearly or yearly subscriptions or accounts that signup for a special pricing plan.(First Month FREE for 3 month Plan)

Termination of any account during a current billing period, including the first day of the month, will become effective at the start of the next billing period and not the date of termination request. Once a billing period begins, including the first day of the month, the subscriber is responsible for all monies due that month.

Internet access is available in over 8400 Dial-up locations across North America through HI Surfer.Net.

Definition of the "Unlimited Plan" is as follows:

The Unlimited Plan is, "a monthly Internet access plan that allows the user to actively use their connection and accumulate online hours without having to pay overtime after a certain number of hours."

Unlimited does NOT mean that you may leave your connection on for extended periods of time without actively using the account. EXAMPLE: Connecting before you go to work and leaving your system online when you are not there actively using it.

The use of any hardware or software program(s) to "keep alive" your connection or to automatically reconnect if the connection is dropped is prohibited. The reason for this limitation is simple: The modems you are connecting to are shared with other HI Surfer.Net users. If you stay connected and are not actively using the Internet, you are keeping other users from having access to the modem you are tying up. We are sure you would not want other users keeping you from accessing the modems, so please give them the same courtesy.

HI Surfer.Net reserves the right to suspend or terminate any account abusing this policy. HI Surfer.Net reserves the right to drop any connection for inactivity. Absolutely no refunds will be given to any account suspended or terminated for abuse of the Unlimited Plan.

HI Services and HI Surfer.Net is not responsible for any long distance charges associated with
your dialing into a dial-up number the is not local to your area. It is your responsibility to make sure you are calling a local number.
